Terms & Conditions for Online Farm Equipment Auctions managed by:

All bidders herby certify that they have read and fully understand the terms and conditions listed below and they agree to be bound thereby. Each auction may have additional terms that are not listed here. It is the buyer’s responsibility to understand all the term and conditions prior to submitting any/all bids.
Bidding: When you bid your max, the current bid price does not automatically go to your max bid. Someone else has to bid to increase the current price and the computer will automatically bid up to your max in the increments specified. The auction will go to a LIVE, Internet only auction for the conclusion. Bidding will start at the last pre-bid placed on the computer. Bidders can then bid Live, Real Time with the auction via the computer, via phone, or absentee. In some cases, you will also be able to bid live in person by being on location where the auction closing is taking place. Internet bidders who desire to make certain their bid is acknowledged should use the pre-bidding feature and leave their maximum bid 24-hours before the ending of the auction.
Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. Girard Auction is acting as agents for the seller. All auctions are sold with reserve unless otherwise stated. Reserves, if any, will not be disclosed. All final bids are subject to seller’s confirmation. Only the top bidder will be contacted to the status of his/her bid.
Payment: All payments must be made within or before 72 hours of being invoiced after the close of the auction. Acceptable forms of payment include: Cash, Personal Check accompanied by Bank Letter of credit, Cashier’s Check accompanied by Bank Letter of credit, Visa/MasterCard on purchases less than $20,000 (5% Buyer’s Premium applies), Bank Wire Transfer ($25 Service fee applies), or Check by Fax accompanied by Bank Letter of Credit. If payment is not made within the stated time period, the item will be considered in default and may be turned over to a collection agency. No Partial payments will be accepted. Payment cannot be made directly to the seller.

State sales tax, transfer, license fees & document fees will be charge where applicable. No items will be released until full payment clears our controller’s office. Once full payment is received, buyer will be emailed & mailed a paid invoice and the seller will be notified that the item may be released.
“As-is, Where-is”: While the information we provide on items is deemed correct, no warranties are expressed or implied as to any item being sold and you agree to purchase and accept the item in an as-is condition. Information on items is obtained by us from the sellers and you hereby agree to hold harmless Girard Auction & its employees for any errors or omissions regarding the items being sold. The information includes, but not limited to year, model, machine or engine hours, physical condition, options, electrical, features and other data pertinent to the value of the item. All items are sold as-is, where-is unless specific factory or seller issued warranties are listed in the item description.
Inspections: All items will be available for personal inspections during normal business hours at the dealership. You acknowledge that you have the right and responsibilities to inspect the items personally, or have a third party representative inspect the items for you. That by bidding on an item you have agreed to accept that item in its present condition and its present location and with the description provided whether accurate or not. Personal inspection of the property is strongly encouraged.
Possession: Upon your winning accepted bid of an item, that item shall immediately become your responsibility and be at your risk, whether you have paid for that item or not. You agree that Girard Auction and their seller’s are not responsible for lost, stolen, or damaged items and will not reimburse or discount items for any type of loss. You are responsible for any loading, packaging or shipping involved with your purchase. You agree to remit payment and remove from the auction property any purchases within the stated time for the auction being conducted. You further understand and agree that failure to remove items in the stated time for the auction will subject you to moving and storage fees unless arrangements have been made with the seller.
Additional Conditions: When using our online auction services, you are making firm commitments to purchase said items and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason. Non Paying bidders or fraudulent bidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations. You also acknowledge that the Internet may be an unreliable and error prone network. Girard Auction will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Girard Auction and their employees harmless for any interruptions in online bidding. Further, the auctioneer has sole discretion to accept or refuse any bid. Girard auction retains the right to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice. Girard Auction reserves the right to remove a bidder for not complying with the terms and conditions. Girard Auction reserves the right to cancel and/or remove a listing at anytime for any reason.
Ride and Drive: If a unit is sold with “Ride and Drive”, it will be stated in the description of that item. “Ride and Drive” means that the purchaser has the right to inspect the Machine after the purchase, and if the machine is not what was described, the buyer is entitled to a refund. The inspection must be made at the dealership of purchase before it leaves the property. If the Machine leaves the property, you are accepting it in its current condition and the “Ride and Drive” is no longer valid. “Ride and Drive” pertains only to the Motor, Transmission, and Drive train. Not included and not limited to in the “Ride and Drive” are issues with electrical, cosmetic, appearance, tire/track wear, hydraulics, air conditioning/heat, interiors, and so on. “Ride and Drive” will only be offered on select units of Tractors, Combines, & Vehicles (no Implements or Machinery).
Buy it Now: A “Buy it now” option will be included on selected pieces of equipment. This price is non-negotiable and is the lowest amount the seller is willing to take PRIOR to the ending of the auction. This price does not indicate a reserve if any on the item. The item may sell for less or for more at the live auction conclusion. Buy it Now prices may be removed prior to being exercised or added at any time.
Buyer’s Premium: Most of our Machinery Auctions will not have a buyer’s premium. If there is a Buyer’s Premium, it will be listed in the terms of the specific auction.
Titles: Titles will be filled out in the name of the purchaser unless otherwise directed. All titles will be endorsed—no open titles will be issued. There will be a $25 title transfer fee for each title. Title will be mailed to the buyer by certified mail within 30-day after payment is received.
