Terms And Conditions

10% Buyers Premium on all purchases. All sales final. Sales tax now charged to online purchases! Your local tax rate will be charged! Some states many not apply, please call our office if you have sales tax questions.

This is an ONLINE ONLY AUCTION--NO LIVE AUCTION. 5 items will close every minute. If a bid is placed on an item in the last 40-seconds, it will reset the countdown clock at 40-seconds for that item. A maximum of 5 items will be open on the screen at one time. At closing time, refresh your page and click on the bright red link "Auction Closing Now--Click here for closing screen".
If you want to pick up your items after the auction, they will not be ready to be picked up until starting Wednesday at 9:00 a.m.! NO EARLIER Please to allow for invoicing and sorting of the items.

NEW PAYMENT SYSTEM--PLEASE READ: You will receive an emailed invoice from Sarah Girard the day following the auction. The email will have a link to pay for your purchases via Visa, MasterCard or Discover. Please use this new system, we can no longer store credit card numbers for regular customers. If you are picking up your items at our facility, you are welcome to pay with cash, check or credit card when you get here. Checks are accepted on larger purchases, but the credit card is a much simpler and faster system on our end.

NEW SHIPPING SYSTEM: NEW SHIPPING SYSTEM – PLEASE READ! We are happy to announce the recent launch of our new shipping system through Shipping Saint. Now, after you have paid for your purchases; you will receive a text & email during each step of the shipping process. When your package is ready to ship, you will be asked to verify your address and then pay for your shipping directly through the text/email. Once paid, a label is generated in our office and the package is shipped. You will now know the exact cost you’re paying, the tracking number and how it is being shipped. ALSO, we now have extremely competitive business rates through UPS & USPS; so your items will be shipped at the absolute lowest cost possible! Shipping: Buyer pays any and all shipping costs. Girard Auction will handle all shipping. All items will be insurance through the carrier or a third party at additional costs to the buyer. NO items will be shipped without insurance. All shipping will be completed within 10 business days of full payment being received after the auction. You must pay for the shipping costs through the email you receive from Shipping Saint

SD Sales tax will be charged to all SD resident buyers and any out of state buyer that picks up their purchases at our facility. Due to new Internet Taxation laws, online buyer's are subject to their local sales tax as well (not all states apply). If you have a SALES TAX RESALE CERTIFICATE you will be exempt, but we must have a copy of the certificate. Sales tax is also charged on our handling fee when shipping.


INSURANCE CLAIMS: If you receive a damaged item, please keep all packaging including the box & packaging material all call our office ASAP and we will work with you on the settlement. PLEASE DO NOT JUST SHIP THE ITEMS BACK TO US without contacting us FIRST!

All bidders herby certify that they have read and fully understand the terms and conditions listed below and they agree to be bound thereby. Each auction may have additional terms that are not listed here. It is the buyer’s responsibility to understand all the term and conditions prior to submitting any/all bids.

Bidding: When you bid your max, the current bid price does not automatically go to your max bid. Someone else has to bid to increase the current price and the computer will automatically bid up to your max in the increments specified. This is an online only auction and you can also bid live in our closing screen.

Internet bidders who desire to make certain their bid is acknowledged should use the pre-bidding feature and leave their maximum bid 24-hours before the ending of the auction.

Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. Girard Auction is acting as agents for the seller. All auctions are sold with reserve unless otherwise stated. Reserves, if any, will not be disclosed. All final bids are subject to seller’s confirmation. Only the top bidder will be contacted to the status of his/her bid.

Payment: All payments must be made within or before 72 hours of being invoiced after the close of the auction. Acceptable forms of payment include: Cash, Personal Check, Cashiers Check, Visa/MasterCard on purchases less than $5,000, Bank Wire Transfer ($25 Service fee applies). If payment is not made within the stated time period, the item will be considered in default and may be turned over to a collection agency. No Partial payments will be accepted.

State sales tax, transfer, license fees & document fees will be charge where applicable. No items will be released until full payment clears our office. Once full payment is received items will be turned over to our shipping department unless otherwise directed for pickup.

“As-is, Where-is”: While the information we provide on items is deemed correct, no warranties are expressed or implied as to any item being sold and you agree to purchase and accept the item in an as-is condition. Information on items is obtained by us from the sellers and you hereby agree to hold harmless Girard Auction & its employees for any errors or omissions regarding the items being sold.

That by bidding on an item you have agreed to accept that item in its present condition and its present location and with the description provided whether accurate or not. Personal inspection of the property is strongly encouraged.

Additional Conditions: When using our online auction services, you are making firm commitments to purchase said items and are entering into a legal and binding contract. Bids may not be canceled or retracted for any reason. Non Paying bidders or fraudulent bidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations. You also acknowledge that the Internet may be an unreliable and error prone network. Girard Auction will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Girard Auction and their employees harmless for any interruptions in online bidding. Further, the auctioneer has sole discretion to accept or refuse any bid. Girard auction retains the right to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice. Girard Auction reserves the right to remove a bidder for not complying with the terms and conditions. Girard Auction reserves the right to cancel and/or remove a listing at anytime for any reason.
